Irrefutable presumption of legitimacy of child and the D.N.A. test: An analysis of Sec-112 of the Evidence Act 1872.

Abstract :

DNA testing is receiving recognition as a highly accurate means of scientific evidence. One of the most apt applications of this technique happens to be resolving paternity disputes; however the bar against disproving the Presumption of Legitimacy of a Child as granted by the Indian Legislature through Section 112 of the Indian Evidence Act may be disproved by limited means. Until the position of law changes, paternity being disproved is a difficult issue with or without scientific aid. However, considering the intent of the Legislature to prevent illegitimating a child, the question assumes several complex dimensions.
