AN OVERVIEWOFINTELLECTUAL PROPERTY RIGHTS IN EDUCA TION SECTOR IN INDIA

Abstract :

Intellectual property refers to creation of mind such as inventions, literary and artistic works, designs and symbols, names and images used in commerce. An intellectual property , e.g. a patent, is an exclusive right granted for an invention which is a product or a process that provides a new way of doing something or offers a new technical solution to a problem because of various financial, economic and social benefits attached to these creations, for the creator as well as for the general public. It becomes all the way more important to protect such creation. Intellectual property laws give exclusive rights to the owners for a variety of intangible assets in the form of patents law , trademarks act, copyrights, etc. The objective is to foster an environment in which creativity and innovation can flourish. However no law can be implemented without its awareness. The objective of the present article is to highlight the importance of protecting intellectual property and also to show the level of awareness regarding the intellectual property laws in Indian scenario especially in research institutes and universities. The article also shows the status of Indian Patent regime with the United States.
