SEXUAL VIOLENCE AGAINST WOMEN WITH DISABILITIES AND THE LEGISLA TIVE MEASURES IN INDIA

Abstract :

W omen with disabilities are at greater risk for victimization of 'sexual violence' or 'sexual assault' because of lack of knowledge, education and awareness of their rights and their powerless position in society . V ery few cases manage to get reported and legal actions are initiated. But most of these cases that reached the courts ended in acquittal. In many cases such women are unable to comprehend or communicate about such acts of violence or assault they face. Some of the reasons behind this low conviction are common such as faulty investigation procedure and medical examination, not recording the testimony of the victim during the trial etc. But the core reason is fear of reporting and if reported the statement seldom taken seriously by the authorities. In this context the researcher focuses on sexual assault committed against women with disabilities in India, related legal issues, international legal developments such as UNCRPD, CEDA W etc and their impact on domestic law to bring reform in the existing law to prevent sexual violence.
