FREE SPEECH V. FAIR TRIAL: A CONUNDRUM OF COMPETING CONSTITUTIONAL CLAIMS

Abstract :

The present day popular democracy is enshrined not only on the traditional three pillars of Legislature, Executive and Judiciary but is also dependent for its survival upon the Media which has thus rightly been hailed as the Fourth Estate of democracy that keeps the other three estates in check. However in its overzealous pursuit to discharge this sacrosanct duty, the media sometimes reincarnates itself as a public court (Janta Adalat) which causes undue interference in the criminal adjudication system. This paper seeks to analyse this dichotomy between the two competing claims of constitutional rights, i.e. free speech vis a vis fair trial and attempts to analyse whether in the modern era media has assumed the role of both the judge, jury and the executioner.
